Terms & Conditions

Applicable to hotel rooms, restaurant services and banquet/event services

These Terms & Conditions (“Terms”) govern the use of services provided by UTSAV HOTEL AND RESORT under the brand name Utsav Hotel. By making a reservation, placing an order, using our facilities, checking in, attending an event or making a payment, the guest/customer/event organiser acknowledges that these Terms apply.

A. General Terms

  1. The Hotel may accept or decline a reservation, order or event request based on availability, operational requirements, legal restrictions or other legitimate reasons.
  2. Rates, inclusions, taxes, packages and offers are as displayed/communicated at the time of booking. Applicable taxes and government levies will be charged as required by law.
  3. Special offers, corporate rates, packages and negotiated rates may have separate conditions. Where a specific written rate agreement conflicts with these general Terms, the specific agreement will prevail for that booking.
  4. Guests must provide accurate information and valid identification/documents required for check-in, guest registration, event booking, billing or legal compliance.
  5. The person making a booking or signing an event agreement represents that they are authorised to do so and is responsible for payments and obligations arising from the booking.
  6. The Hotel may require a valid payment method, advance payment, security deposit or other guarantee depending on the booking or event.
  7. The Hotel may refuse service or cancel a reservation where required by law, safety/security considerations, fraudulent activity, material misrepresentation or serious violation of Hotel rules.
  8. Guests are responsible for loss or damage caused by them or members of their group to Hotel property, subject to applicable law.

B. Hotel Room Terms

  1. Published check-in time: 12:00 noon. Published check-out time: 10:00 AM.
  2. Early check-in is subject to room availability. It may be provided without additional charge where available, unless a particular rate/package states otherwise.
  3. Late check-out is subject to availability and may attract additional charges as communicated by the Hotel.
  4. At check-in, guests may be required to reconfirm their departure date. If a guest departs earlier than the confirmed departure date, an early-departure charge may apply where stated in the applicable rate or booking confirmation.
  5. No-show: for a confirmed reservation where the guest does not arrive, the Hotel may retain/charge an amount equivalent to one night’s room and applicable taxes, unless the booking/rate has different no-show terms.
  6. Room occupancy, extra-person charges, child policies, bed arrangements and other room-specific conditions are governed by the applicable booking/rate plan.
  7. Guests must comply with applicable laws and Hotel safety, fire, security and conduct requirements. Illegal, hazardous or disruptive activities are prohibited.

C. Restaurant Terms

  1. Menu items, prices, availability, portion sizes and ingredients may change without prior notice, subject to applicable law.
  2. Prices and taxes will be as displayed or communicated at the time of order/billing.
  3. Guests should inform the restaurant of known food allergies or dietary restrictions before ordering. The Hotel will take reasonable care but cannot guarantee an allergen-free environment unless expressly confirmed.
  4. Restaurant reservations are subject to table availability and may have seating-time limits during busy periods or special events.
  5. For takeaway, delivery, advance orders or special menus, separate payment and cancellation conditions may apply.

D. Banquet / Event Terms

  1. Utsav Hotel provides banquet/event facilities and may offer two banquet spaces. Final hall allocation, capacity, menu, package, timing and inclusions must be confirmed in writing in the event booking/order form.
  2. An event is confirmed only after the Hotel receives the required advance/payment and written confirmation, subject to availability.
  3. The event organiser is responsible for providing accurate guest count, event timings, programme details, menu selections, special arrangements and other requirements within the timelines specified by the Hotel.
  4. Final guest count and menu/package changes may be subject to minimum guarantees, additional charges and availability.
  5. Outside food, beverages, decorators, entertainment, equipment or vendors are permitted only with prior written approval and may be subject to applicable charges or restrictions.
  6. The organiser is responsible for damage caused by the organiser, guests, vendors or contractors engaged for the event, subject to applicable law.
  7. The Hotel may stop or restrict an activity that creates a safety, legal, nuisance or security risk.

E. Corporate / Negotiated Rates

  1. A negotiated rate is valid only for the agreed contract period and subject to the written corporate agreement.
  2. Unless expressly agreed otherwise, negotiated rates may be subject to non-last-room-availability (NLRA) conditions and may not apply during specified peak-demand periods.
  3. The Hotel may amend published or corporate rates by providing advance notice as specified in the applicable corporate agreement.
  4. Reservations made through travel agents or third-party platforms may not qualify for direct corporate offers unless expressly stated.

F. Payment, Billing and Credit

  1. Direct-payment reservations may require a valid card guarantee, advance payment or other acceptable guarantee.
  2. Corporate credit billing is subject to the Hotel’s credit approval process. Credit is not automatic merely because a company has previously stayed at the Hotel.
  3. All invoices are subject to applicable taxes and statutory requirements.
  4. The Hotel may suspend services or decline additional credit where outstanding amounts are overdue.

G. Limitation and Force Majeure

  1. The Hotel will take reasonable steps to provide confirmed services. However, the Hotel will not be responsible for failure or delay caused by events beyond its reasonable control, including natural disasters, government restrictions, public emergencies, strikes, utility/network failures, civil disturbance or other force majeure events, subject to applicable law.

H. Governing Law and Jurisdiction

  1. These Terms are governed by the laws applicable in India. Subject to applicable consumer-protection and other mandatory laws, disputes shall be subject to the competent courts/authorities having jurisdiction over Banswara, Rajasthan.

I. Acceptance

  1. By booking, paying, checking in, placing an order, attending an event or signing the acknowledgement form, the customer confirms that they have had an opportunity to read and understand these Terms and agree to comply with them.
